The controversy surrounding Dr. Lawrence Muganga’s failed vetting as Minister of State for Internal Affairs has raised a fundamental legal question that goes far beyond one individual: Can a Ugandan legally hold citizenship of three countries at the same time?

For days, public debate has focused on whether Dr. Muganga possesses passports from Uganda, Rwanda and Canada.

While he has denied holding Rwandan citizenship, it is worth examining what Ugandan law would mean if Parliament’s claims were true and he indeed held citizenship of all three nations.

The answer reveals a potential legal grey area that could have significant implications for his eligibility to serve in government.

Uganda Allows Dual Citizenship, Not Triple Citizenship

Uganda’s Constitution and the Uganda Citizenship and Immigration Control Act recognize dual citizenship.

The key word is “dual.”

The legal framework was introduced to enable Ugandans living abroad to acquire citizenship in another country without automatically losing their Ugandan nationality. The reform was largely aimed at attracting investment, skills and expertise from the Ugandan diaspora.

In practice, dual citizenship means a Ugandan can simultaneously be a citizen of Uganda and one other country.

If Dr. Muganga were found to possess citizenship of Uganda, Canada and Rwanda at the same time, critics argue that this would move beyond dual citizenship into what is effectively multiple citizenship.

The law is largely silent on triple citizenship because lawmakers primarily contemplated a situation where a Ugandan would acquire one additional nationality.

This creates the central legal question: Does a person holding citizenship of three countries still qualify under Uganda’s dual citizenship regime?

Could Triple Citizenship Invalidate Ugandan Citizenship?

Not necessarily.

There is no explicit provision in Ugandan law that automatically strips a citizen of Ugandan nationality merely because they acquire citizenship of more than one foreign country.

However, legal experts note that a person seeking recognition as a dual citizen must disclose all citizenships held and comply with registration requirements imposed by the Directorate of Citizenship and Immigration Control.

Failure to make full disclosure could potentially create legal complications regarding the validity of citizenship declarations and applications submitted to Ugandan authorities.

Therefore, the issue may not be whether Muganga automatically ceased being Ugandan, but whether all citizenship declarations made to immigration authorities were complete and accurate.

The Bigger Problem: Eligibility for High Office

Even if triple citizenship does not automatically extinguish Ugandan citizenship, another challenge emerges.

Uganda places restrictions on holders of dual citizenship who seek certain public offices.

Positions connected to national security, sovereignty and strategic decision-making have historically attracted greater scrutiny.

The Ministry of Internal Affairs is one of Uganda’s most sensitive ministries. It oversees immigration, citizenship, national identification systems, prisons and internal security agencies.

If a person simultaneously owes legal allegiance to Uganda, Rwanda and Canada, critics argue that questions of divided loyalty become unavoidable.

This appears to be the concern that influenced members of Parliament’s Appointments Committee during Muganga’s vetting.

The debate therefore shifts from citizenship status to suitability for office.

A person may legally remain Ugandan while still being considered ineligible for particular government positions because of their foreign allegiances.

Why Rwanda Matters More Than Canada

The political sensitivity surrounding Rwanda is arguably greater than that surrounding Canada.

Uganda and Rwanda have experienced periods of diplomatic tension over the past decade, including border closures, allegations of espionage and disagreements over regional security issues.

Consequently, allegations that a prospective Internal Affairs minister may simultaneously hold Rwandan citizenship carry a political weight that goes beyond the legal technicalities of dual citizenship.

For some lawmakers, the concern is not merely the number of passports involved but the strategic implications of holding citizenship in neighbouring states whose interests may not always align with Uganda’s.

Had the allegation involved Uganda, Canada and Australia, for example, the political reaction might have been considerably different.

A Test Case for Uganda’s Citizenship Laws

The Muganga saga has exposed a major gap in Uganda’s citizenship framework.

While the law clearly recognizes dual citizenship, it provides limited public guidance on situations involving three or more nationalities.

If evidence ever emerged that a Ugandan officially holds citizenship of Uganda, Rwanda and Canada simultaneously, courts may eventually be required to determine whether such an arrangement falls within the spirit of Uganda’s dual citizenship laws or violates them.

The case could become one of the most significant legal tests of Uganda’s citizenship regime since dual citizenship was introduced.

The Bottom Line

Assuming Dr. Lawrence Muganga holds citizenship of Uganda, Rwanda and Canada at the same time, it does not automatically mean he has ceased to be Ugandan.

However, it would raise serious legal and constitutional questions regarding compliance with Uganda’s dual citizenship framework, disclosure obligations to immigration authorities and eligibility to hold a sensitive ministerial position such as Internal Affairs.

In that scenario, the real issue would not be whether Muganga is Ugandan.

The bigger question would be whether Uganda’s laws were ever designed to accommodate a citizen who owes allegiance to three nations simultaneously—and whether such a person can be entrusted with one of the country’s most security-sensitive offices.
