The High Court in Kiboga has sentenced prison warder Anguyo Moses to death after convicting him of four counts of murder in a case that laid bare a shocking betrayal of public trust by a trained officer entrusted with an AK-47 rifle.
Justice Jane Okuo Kajuga handed down the ultimate sentence after finding that the aggravating circumstances surrounding the killings overwhelmingly outweighed the factors pleaded in mitigation.
The court heard that Anguyo, himself a prison officer and therefore a public servant trained and trusted to handle firearms, was responsible for the deaths of four people, including two public servants who were killed while in the line of duty and a one-and-a-half-year-old child.
The killings, the court found, were aggravated by the use of an AK-47 rifle, the targeting of victims on the basis of their tribal identity, and the devastating consequences left behind for the families of those killed.
Six children were left orphaned as a result of the violence.
One of the victims, identified as Ayebare, was an architect, with the court noting that the country had also been deprived of productive citizens whose lives and potential were abruptly cut short.
‘AGGRAVATING FACTORS FAR OUTWEIGHED MITIGATION’
In sentencing Anguyo, Justice Kajuga considered both the circumstances that worsened the gravity of the offences and the factors advanced in his favour.
Among the aggravating factors were the scale of the crime, the killing of four people, the murder of public servants in the course of their duties, the death of the infant, the use of a military-style firearm and the alleged targeting of victims based on tribal identity.
The court also took a particularly serious view of the fact that the offender was a trained prison officer entrusted with a firearm.
Rather than upholding the law and protecting the public, the court found that Anguyo had committed a grave breach of the trust placed in him.
Anguyo’s guilty plea, his youth, remorse, apology to the public and willingness to compensate the victims of the robbery charges were all considered as mitigating factors.
The court also considered the absence of premeditation.
But those factors were not enough to save him from the death sentence.
Justice Kajuga concluded that the aggravating circumstances far outweighed the mitigating factors.
ROBBERY AND THREATS
Beyond the four murder convictions, Anguyo was also sentenced to two years’ imprisonment on each of two counts of aggravated robbery and three years’ imprisonment for threatening violence.
He was further ordered to compensate the victims for property stolen during the criminal episode, including Shs35,000 for a pair of trousers and Shs25,000 for an Arsenal jersey.
The sentence brings a dramatic conclusion to one of the most disturbing cases involving a member of Uganda’s security and law enforcement establishment, with a prison officer ultimately facing the harshest punishment available after admitting responsibility for multiple violent crimes.
DPP HAILS CONVICTION
The Office of the Director of Public Prosecutions said the outcome reaffirmed the criminal justice system’s commitment to holding offenders accountable for grave crimes.
The prosecution was led by Dr Daisy Nabasitu, an Assistant Director of Public Prosecutions, and Stephen Ariong, a Senior State Attorney.
In a statement issued by Public Relations Officer Jacquelyn Okui, the DPP extended sympathies to the families of the deceased and said the outcome underscored the seriousness with which the law treats the unlawful taking of human life and violent criminal conduct.
The conviction and sentencing, the DPP said, reflected the combined efforts of prosecutors, the Uganda Police Force and the Judiciary in pursuing accountability and justice for victims and their families.
For Anguyo Moses, however, the judgment marks a devastating fall from a prison officer entrusted with enforcing the law to a condemned man sentenced to death for extinguishing four lives.
The case also leaves behind families still carrying the weight of an irreparable loss — and six children growing up without the parents whose lives were taken in the violence.
