The Special Court presided over by Dr. James Alala Deng on Monday ruled that it has full jurisdiction to hear the case against First Vice President Dr. Riek Machar and seven co-accused, who face charges including treason and crimes against humanity related to the March 2025 Nasir clashes.
The decision came after the defence argued last week that the court lacked authority to try Machar, citing his immunity as Vice President and claiming jurisdiction instead lay with the Hybrid Court. However, Judge Alala, supported by fellow judges Stephen Simon Isaac and Pur Majok, dismissed these objections, affirming that the Special Court was legally constituted by Chief Justice Benjamin Baak Deng.
The court also struck two defence lawyers, Wernyang Kiir Wernyang and Deng John, from the case for lacking valid practising licences, reducing the defence team from six to four members.
In its opening statement, the prosecution alleged that the Nasir violence was planned, financed, and coordinated by SPLA-IO commanders, including Machar and others. The case, which has drawn significant attention, continues Wednesday with witness testimony.
All eight accused, including Puot Kang Chuol, Gabriel Duop Lam, and Dr. Machar, were present during the session at Freedom Hall.
