The Criminal Investigations Department of Police has summoned Lawyer Male Mabirizi to Jinja Police about his recent case seeking court to find the Busoga Kingdom Leader Kyabazinga William Nadiope guilty of bigamy.

According to the Police summons seen by Uganda Radio Network, Police require Mabirizi ‘s attendance as a key witness in a private prosecution he brought up against Nadiope his wife Jovia, the Archbishop of Church of Uganda Stephen Kazimba Mugalu as accused persons in fictitious marriage and other charges in his private criminal case number 746 of 2023.

Kiira Regional CID Officer Detective Senior Superintendent of Police Monday Johnson Agaba is handling the matter.

Under Section 27A of the Police Act, they are empowered to invite/summon/require Mabirizi to appear.

According to the Police, the DPP has since taken over the conduct of the criminal proceedings in the said matter inline with her constitutional mandate.

“The DPP to whom the police is the investigative body, have reason to believe that you have valuable Information/Exhibits /documents to assist police investigations in a case of fictitious marriage, bigamy and other charges,” reads the letter.

It adds , “you are therefore required to report to Kira Central Division -Jinja Central Police Station to the office of the Divisional CID on Tuesday the 13th of February 2014 at 1100 hours.

The Regional CID officer says that Mabirizi should report to Detective Assistant Superintendent of Police Evelyn Anyango. His immediate response to their request is highly appreciated as a law-abiding citizen.

he summons stem from the November 20th, 2023 private Prosecutions levied against Kyabazinga, his wife and some of the  people who witnessed his wedding with Jovia on November 18th, 2023.

According to Mabirizi, on the said date, at Christ Cathedral Bugembe being the scene of crime now, Nadiope, Jovia, Kazimba Mugalu and the Buganda Kingdom Queen Sylvia Nagginda participated in, officiated and witnessed a ceremony of marriage well aware that it was invalid, criminal and void.

This he states is because Nadiope had reportedly earlier contracted marriage before the Registrar of Marriages in England with Alison Anna in December 2016 at Mildam House Bunbaby Road , Portsmouth and during the continuance of marriage.

He thus levied different charges against them including fictitious marriage, bigamy, marriage with a person previously married, unlawfully performing a marriage ceremony and conspiracy to commit felonies against Kazimba and the Buganda Queen.

He prayed for criminal summons to be issued against the listed individuals such that they can appear in court, charges be read to them and they be found guilty and sent to prison to serve their respective sentences.

Speaking to URN, Mabirizi has said he will not go to Police to answer to the summons. ” I will not attend because the takeover of my Criminal case by Jinja Resident State Attorney was premature and unconstitutional which will be set aside,” said Mabirizi.
