City lawyer, Hassan Male Mabirizi has tasked the ministry of Works and transport to produce a certified copy of President Museveni’s driving permit.
Male Mabirizi says he intends to sue president Museveni because he doesn’t qualify to get a driving permit.
“I have several times seen Museveni drive government vehicles yet I know he is disqualified from obtaining a Driving Licence given likely impairment on his vision most likely caused by elderly age estimated 2b around 80 years. He committed a crime under S.58(1)TRSA,” said Mabirizi.
Mabirizi says he needs the certified copies of Museveni’s driving permit to help him in building his case.
Below is Mabirizi’s full letter to the Permanent Secretary Ministry of Works and Transport.
PERMANENT SECRETARY, 24 January 2022 MINISTRY OF WORKS & TRANSPORT, KAMPALA.
Dear Sir/Madam; CERTIFIED COPIES OF VALID DRIVING LICENSE, IF ANY, FOR YOWERI TIBUHABURWA KAGUTA MUSEVENI
1. I address you in my capacity as a civically active Ugandan with a citizenry duty under Article 17(1)(d) of the Constitution “to protect and preserve public property” and with an inherent Fundamental Human Right under Article 41 of The Uganda 1995 Constitution and Section 5 of The Access to information Act, 2005 to access information in possession of public officers.
2. I have several times seen YOWERI TIBUHABURWA KAGUTA MUSEVENI drive government vehicles yet I know he is disqualified from obtaining a Driving License given likely 2 4 JAN 20r pairment on his vision most likely caused by elderly age estimated to be around 80 years hence if he has one, he committed a crime under Section 58 (1) of The Traffic & Road Safety Act(TRSA) which states that “Every person who is disqualified under this Act from obtaining a driving permit and who applies for or obtains a driving permit while he or she is so disqualified commits an offence and is liable on conviction to imprisonment of not less than one year and not exceeding three years; and any driving permit so obtained shall be of no effect.”
3. If he has no license, then he committed an offence Contrary to S. 35(1) of TRSA which states that “A person shall not drive any class of motor vehicle, unless he or she is in possession of a copy of a valid driving licence…in respect of that group of motor vehicle,” punishable by 6 months imprisonment under S. 76 of TRSA
4. I therefore request for the true position of the Public Record because I intend to institute Criminal Proceedings against him for driving sensitive Government vehicles illegally.
5. I need to remind you that the law gives you a maximum of 21 days to respond failure of which may lead to separate Criminal Prosecution against yourself for CONCEALING A RECORD.
