Kyaddondo\nEast MP, Robert Kyagulanyi, should be arraigned in court and not detained in\nhis home if he has committed crimes, the Deputy Speaker, Jacob Oulanyah, has\nsaid.<\/p>\n\n\n\n
Oulanyah,\nwho was presiding over the plenary sitting on Wednesday, 24 April 2019, said\nthat the law provides for the arrest of only that person who is committing, has\ncommitted or is about to commit an offence.<\/p>\n\n\n\n
\u201cIf\nthe police has just established an offence that Kyagulanyi committed, then he\nshould be taken to the courts of law but not his house,\u201d he said, adding that\n\u201cThe government cannot hold someone in detention without pronouncing itself on\na crime they have committed or pressing charges.\u201d<\/p>\n\n\n\n
The\nDeputy Speaker\u2019s guidance followed a statement by the Minister of Internal\nAffairs, Hon. Mario Obiga Kania, on the continued arrest of Hon. Kyagulanyi,\nwho is also a renowned musician.<\/p>\n\n\n\n
Legislators\nyesterday demanded that government explains the continued confinement of the MP\nand why the Police prevented him and other opposition members from holding\ntheir scheduled events even after complying with the Public Order Management\nAct.<\/p>\n\n\n\n
Members\nalso sought explanations from government about the circumstances under which\ntheir colleague is being detained at his home in Magere, Wakiso district.<\/p>\n\n\n\n
Hon.\nTheodore Ssekikubo (NRM, Lwemiyaga) said that the MP was being confined by the\npolice at his home without any clear explanation. He said that government was\nunlawfully and illegally detaining Kyagulanyi at his home without pressing\ncharges.<\/p>\n\n\n\n
\u201cYou\narrested Kyagulanyi and took him to his home on Sunday where you are holding\nhim without any charges; you should set him free if you have failed to find any\nwrong with him,\u201d he added.<\/p>\n\n\n\n
The\nLeader of the Opposition, Hon. Betty Aol Ocan, said that not allowing\nKyagulanyi to leave his home is similar to putting him in incarceration.<\/p>\n\n\n\n
\u201cThe\nMinister of Internal Affairs should tell us why they are not taking him to\ncourt if they are putting him in confinement? It is impunity for the government\nto treat members of the public, especially a legislator [that way],\u201d she said.<\/p>\n\n\n\n
Ocan\nfurther warned the government saying that the oppressive act of holding\nKyagulanyi in detention and other people that have been detained in the past\nwill have repercussions in the long term as it\u2019s likely to lead to anarchy.<\/p>\n\n\n\n
Minister\nObiga Kania said that Kyagulanyi is being detained for committing some crimes\nand was expected to make statements to the police. <\/p>\n\n\n\n
\u201cWe\nshall take the appropriate action to make sure that we are acting within the\nparameters of the law to detain Kyagulanyi,\u201d he said.<\/p>\n\n\n\n
Oulanyah asked the Minister to provide a definitive statement on the matter, and further advised the minister that his presentations should always be clear and definitive to avoid confusion.<\/p>\n\n\n\n
