The\nHigh Court has allowed Parliament to permit a new firm to operate the Members\nrestaurant and bar.<\/p>\n\n\n\n
High\nCourt Judge, Lydia Mugambe Ssali dismissed an application by Hellenar\u2019s\nRestaurant, the firm that had operated the Parliament Restaurant and Bar for\nthe last three years, to restrain and prohibit the Parliamentary Commission\nfrom hiring out a new service provider.<\/p>\n\n\n\n
Delivering\nher ruling on Tuesday, 15 January 2019, the Judge said that Hellenar\u2019s\nRestaurant is not the only company that can provide the required services to\nParliament.<\/p>\n\n\n\n
\u201cThe\nrestaurant has fallen out of favour with Parliament and therefore, cannot\ncontinue its operations,\u201d she said.<\/p>\n\n\n\n
Hellenar\u2019s restaurant applied for a temporary injunction to restrain and prohibit the Parliamentary Commission from altering or causing the alteration in the status-quo with regard to the operation of the facility.<\/p>\n\n\n\n
Their two year contract to operate the restaurant and bar located on the third floor of the South Wing expired at the end of last year, after a year\u2019s extension.<\/p>\n\n\n\n
In\npreparation for the expiry of the contract and to avoid a break in the\nprovision of services, the Parliamentary Commission contracted another firm,\nRomeo\u2019s Restaurant to operate the facility for the next two years.<\/p>\n\n\n\n
Justice\nMugambe stated that Hellenar\u2019s Restaurant failed to prove a prima facie case\nbecause currently, there is no subsisting contract between Hellenar\u2019s\nrestaurant and Parliament.<\/p>\n\n\n\n
\u201cThe\nParliamentary Commission was even lenient to extend the contract of the\napplicant (Hellenar\u2019s restaurant),\u201d said Mugambe.<\/p>\n\n\n\n
She\nadded that Hellenar\u2019s restaurant did not prove that the company will suffer\nirreparable loss because their loss can be compensated in case of any\ndamages. <\/p>\n\n\n\n
Mugambe\nadded that Parliament has already contracted Romeo\u2019s restaurant and failure to\nexecute the contract may cause the restaurant to sue the institution leading to\nloss of public funds.<\/p>\n\n\n\n
The service provider for the Parliament restaurant and bar provides meals to Members of Parliament, staff and their visitors throughout the working week. <\/p>\n\n\n\n
The provider also supplies refreshments during\u00a0 committee meetings and at various other activities in the precincts of Parliament.<\/p>\n\n\n\n
Meanwhile, the High Court will also hear the application for a judicial review of the procurement process of provision of catering services to Parliament. <\/p>\n\n\n\n
