Abdallah Kitatta, Ibrahim Ssekaja, Johnson Kayondo, Matia Ssenfuka, Amon Twinomujuni, John Ssebandeke, Fred Bwanika, Sunday Ssemogerere, Joel Kibirige, Sowali Ngobi, Hassan Ssengoba, Hassan Ssebata and Hussein Mugema were charged with over five counts that attract a death penalty.<\/p>\n
Chieftaincy of Military Intelligence Unit Disciplinary Court sitting at Mbuya Army Barracks on Monday, remanded the suspects to Kigo Prison.<\/p>\n
\u201cFive (05) charges were preferred against the accused persons of which four are criminal offences of failure a protect war material, contrary a Section 122 (1) and (2) (5) and (i) of the UPDF act, 2005,\u201d reads the statement signed by UPDF deputy spokesperson Lt Col Deo Akiiki.<\/p>\n
He adds that; \u201cThe other charge was unlawful possession of military stores contrary to Sec 161 of the UPDF act.\u201d<\/p>\n
Lt Col Deo Akiiki further said that four of the five charges attract a death penalty upon conviction.<\/p>\n
\u201cThe four criminal offences attract a maximum sentence of death while one attracts life imprisonment respectively.<\/p>\n
\u201cThese Sentences are therefore of capital nature and are not triable by a UDC.<\/p>\n
\u201cHowever, the criminal procedure requires that a court without<\/p>\n
\u201cJurisdiction can only read the charges preferred and remand the accused, and that he or she is not allowed to enter any plea. Therefore, the above accused persons have been remanded to Kigo Prison.\u201d<\/p>\n
Akiiki also explained to why the accused were paraded in a military court.<\/p>\n
\u201cIt should be noted that, Section 119 of the UPDF Act, provides for persons subject to military law.<\/p>\n
\u201cIt further provides under Section 119 (1) (h), (i) that every person found in unlawful possession of arms, ammunitions or equipment ordinarily being the monopoly of \u00a0\u00a0the Defence Forces, becomes subject to military law.<\/p>\n
\u201cIt is on the basis of the above that the mentioned persons have appeared in a Military Court.\u201d<\/p>\n
